Mr. Partha Pratim Das Mrs. Manasi Roy ...For the State Apprehending arrest in connection with Uluberia Police Station Case No. 300 of 2010 dated 15.05.2010 under Section 286 of the Indian Penal Code read with sections 3 and 4 of the Explosive Substance Act, the present application has been preferred.
Mr. Ansari, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. The principal accused has already been granted bail and in the said conspectus, custodial interrogation of the petitioner is not warranted.
Mr. Sur , learned Additional Public Prosecutor appearing for the State, submits that the present petition itself is not maintainable since his prayer for anticipatory bail was refused twice earlier. He further submits that the complaint is of the year 2010 and the petitioner is absconding till date. In view
thereof, the petitioner is not entitled to the relief, as prayed for.
Heard the learned advocates appearing for the respective parties and considered the materials in the case diary.
It appears from the annexures to this petition that the petitioner's prayer for anticipatory bail was refused twice earlier, lastly on 6th July, 2012 and there has been no change in the circumstances of this case subsequent to earlier rejection of the petitioner's prayer for anticipatory bail. In view thereof, the application for anticipatory bail, being CRM No. 2569 of 2021, is dismissed.
