Kutub Uddin ...for the State This is an application seeking an expeditious disposal of the proceedings in which charge-sheet was submitted under Section 406 and 498A of the Indian Penal Code.
Let a copy of the application be served upon Mr. Imran Ali, and Mr. Md. Kutub Uddin, learned advocates, who are present in Court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.
Learned counsel for the petitioner submits as follows. The petitioner is the defacto-complainant in this case. She lodged a First Information Report on 10.1.2019 under Sections 498A, 325, 406 of the Indian Penal Code. A charge-sheet was submitted on 10.12.2019. Yet till date, even charges could not be framed. On 29.6.2021 the learned trial Court fixed the next date of hearing on 21.1.2023. The proceeding has been pending for no fault of the present petitioner.
Learned counsel for the State submits as follows. It does not appear that there is an inordinate delay occasioned in this case.
But, fixing the next date of hearing nearly one and half years is quite exceptional.
I have heard learned counsels for the petitioner and the State and have perused the revision petition.
It does not appear that an inordinate delay has been occasioned in this case. However, it is quite strange that the next date of hearing was fixed after one and half years. In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournments to any of the parties and by preponing the next date to any date in the month of July, 2022 and by deciding the question of consideration of charges at the earliest. With the aforesaid observations, this revisional application is disposed of.
Urgent photostat certified copies of this order may be delivered to the learned advocates for the parties, if applied for, upon compliance of all formalities.
