On the basis of the complaint filed by the petitioner, Uluberia PS Case No. 324/21 dated September 25, 2021 under Sections 420/406 of the Indian Penal Code had been initiated.

The investigation is in progress. During investigation, available witnesses were examined under Section 161 of the Cr.P.C. The place of occurrence was visited. The petitioner was issued notice under Section 91 of the Cr.P.C. for supply of relevant documents. The original agreement dated March 22, 2021 was seized. The FIR named accused was also issued a notice under Section 41A of the Cr.P.C. The monetary transactions were traced, upon collection of relevant documents from the bank. Scientific tests were also conducted on the submersible pump by the Assistant Engineer, Public Health Department,

Uluberia Sub-Division. All the available evidences have been collected. The investigation is in progress. The police report is taken on record.

Under such circumstances, the writ petition is disposed of with a direction upon the Inspector-inCharge, Uluberia Police Station, Howrah Rural District to ensure that the investigation is completed in an impartial, fair and proper manner and expeditious steps are taken in order to reach the investigation to its logical conclusion.

The writ petition is disposed of.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
