2022-04-26Hon'Ble Justice Jay Sengupta2 pages

26.04.2022 SB Ct. No.39 CRR 1104 of 2022 In the matter of : Hare Krishna Samanta Ms. Diksha Ghosh ... for the petitioner This is an application seeking an expeditious disposal of a proceeding being Case No. 147 of 2017 pending before the learned Judicial Magistrate, Contai, Purba Medinipur under Section 138 of the Negotiable Instruments Act.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the complainant in this case. He filed the petition of complaint in the year 2017. Yet, till date the proceeding could not be concluded. This is despite the fact that by an order dated 22.02.2019 passed in C.R.R. 2712 of 2018, a direction was passed to expedite the proceeding. One witness is left to be examined. On several dates the accused prayed for adjournments. The matter has remained pending for no fault on the part of the petitioner. I have heard the submission of the learned counsel for the petitioner and have perused the revision petition. No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

It appears that some delay has been occasioned in concluding the proceeding, especially considering the fact that the same was initiated in the year 2017 and there is a statutory stipulation under the N.I. Act regarding expeditious disposal of a proceeding. In view of the above and in the interest of justice, I request the learned Trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the

parties, preferably within a period of six months from the next date of hearing.

With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
