C.R.M. 2691 of 2019 (AD) 08.05.2023 Court No.29 In Re: - An application under Section 439(2) of the Code of Criminal Procedure, 1973.

And In the matter of: - Mohammad Mursalim Sk ...petitioner.

Mr. Manas Kumar Das ... for the petitioner.

The application is directed against an order dated February 15, 2019 by which the private opposite parties were granted anticipatory bail.

The learned Judge considered the injury report of the injured and the statements of the witnesses recorded under Section 161 of the Code of Criminal Procedure and found custodial interrogation of the private opposite parties was not necessary and, therefore, proceeded to grant anticipatory bail to the private opposite parties. We find no material irregularity in the grant of anticipatory bail by the learned Sessions Judge.

In such circumstances, we find no merit in the present application for cancellation.

C.R.M. 2691 of 2019 is disposed of accordingly. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
