Petitioner claims to have purchased a property which is adjacent to that of the private respondents. It has been alleged by the petitioner that the private respondents are disturbing the peaceful enjoyment of the property and are interfering in the steps taken both for construction and for any other activities at the portion which belongs to the petitioner exclusively.

State has submitted a report. Report reflects that on the basis of complaint of the petitioner Duttapukur PS Case No. 254/2024 was registered for investigation and subsequently, charge sheet has also been submitted before the

jurisdictional court. Admittedly, there are dispute and difference between the petitioner and the private respondent being the adjacent land owners.

So far as the right, title, interest, possession, occupation and usage of the property is concerned, the civil court has domain and the authority to decide the same. This court will not enter into the said domain.

However, having regard to the fact that the petitioner and the private respondents are at loggerhead, I direct the police authorities to keep a strict vigil and ensure that no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 6855 of 2025 is disposed of.

Report submitted be kept with the record.

A copy of the report (without annexure) be handed over to the learned advocate appearing for the petitioner.
