1. The affidavit of service filed today is taken on record.

2. In spite of service, there is no representation on behalf of the school authorities.

3. The petitioner, an Assistant Teacher of a school since 2013.

4. The petitioner had applied for transfer on self medical ground.

5. The earlier application of the petitioner had been summarily rejected by the school authorities in a whimsical and arbitrary manner, holding that the 'Managing Committee had not agreed'. Since the transfer was sought on medical ground, the school ought to have called for a medical verification by the concerned Block Medical Officer Health, (BMOH). Not having done that, the Managing Committee could not have arbitrarily rejected the application of the petitioner. However, since the application was made in the year 2022 in the online mode and a long period of time has lapsed, the petitioner is granted liberty to make

a fresh application on the self-same ground which shall be considered by the school authorities after causing proper medical verification through the concerned BMOH.

6. The school authorities will consider and forward the application of the petitioner by 15th June, 2026 to the concerned D.I. If the petitioner is found otherwise eligible, the concerned D.I. will take necessary steps for expeditious onward progression of the application.

7. Temporary suspension of 'Utsashree Portal' will not be an impediment for the concerned authority to consider the application for transfer of the petitioner. The same shall be considered in an offline mode.

8. With these aforesaid directions, the writ petition is disposed of.

9. There shall, however, be no order as to costs. 10.

Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis.
