This is an application filed by the defendant in a Title Suit No.106 of 2019 praying for expeditious disposal of the injunction application pending before the learned Civil Judge (Junior Division), 1st Court at Alipore, South 24-Parganas. It is submitted by the learned Advocate for the petitioner that an ad interim injunction was passed against the petitioner and the said order has been extended from time to time but final hearing of the injunction application has not taken place.

Now, the pandemic situation is over and the written statement on behalf of the sole defendant has already been filed.

Under such circumstances, this revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), 1st Court at Alipore, South 24-Parganas to dispose of the injunction application as expeditiously as

possible preferably within a period of three months from the date of communication of this order.

This Court has not gone into the merits of the claims and counterclaims of the parties and the learned Court below will decide the injunction application on its own merits without being influenced by any observation made hereinabove. The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application along with a server copy of this order to the opposite party within seven days.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
