Petitioner is aggrieved by the fact that although cause of action arose within the jurisdiction of Hare Street police station, particularly with regard to the nature of the offences and the evidence to be collected in such offences, unnecessarily a zero FIR has been drawn up by Hare Street police station and the case has been proposed to be transferred to Galsi police station, Purba Bardhaman.

Having considered that the offence which has been alleged has its genesis in the social networking platform, I

am of the view that let the case be transferred to Cyber Crime Police Station, Kolkata.

Cyber Crime Police Station, Kolkata will assess in respect of the legal provisions under which the case has been registered and thereafter while investigating to the case if they are of the opinion that some other provisions are to be added they would apply their mind and the materials collected and thereafter take steps in accordance with law.

With the aforesaid observations WPA 6270 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
