Chatterjee ...............For the petitioner Learned Counsel for the petitioner submits that his clients do not want to proceed with the case and pray for dismissal for non-prosecution in view of the order passed by the Learned ACJM, Bidhannagar in GR case no. 15 of 2019 dated 06.04.2021 (copy filed) wherein the Learned Magistrate has held that the accused was present before the Court. The defacto complainant was present but declined to take part in the hearing.

On perusal of the case record Learned Magistrate held that the dispute between parties civil in nature and the investigating officer has filed final report in the said case that the dispute is civil in nature. Learned Magistrate has accepted this final report and discharged both the accused persons i.e. Amit Anand and Minakshi Anand from the said case.

The case thus stands dismissed for non-prosecution. (Shampa Dutt (Paul), J.)
