Report submitted by Mr. Panda, learned advocate appearing for the State be kept with the record. The present revisional application was preferred with a prayer for transfer of the proceedings relating to Jamboni Police Station Case No.70 of 2020 dated 04.11.2020 under Sections 498A/325/307 of the Indian Penal Code. As such, petitioners have prayed for transfer of the case from the court of learned Chief Judicial Magistrate, Jhargram to the court of learned Additional Chief Judicial Magistrate, Serampore, Hooghly and/or any other court within the district of Hooghly.

The reasons so assigned in the application relate to their professional commitments as well as family commitments, the same do not make out a case for transfer. If the petitioners are unable to attend the court, in such circumstances, they may be allowed to be represented through their learned advocate under Section 317 of the Code of Criminal Procedure or their presence may be dispensed

with as the learned court deems fit and proper in accordance with Section 205 of the Code of Criminal Procedure. With the aforesaid observations, CRR 757 of 2021 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
