The contents of the writ petition relate to a landlord and tenants dispute, while the petitioner claims that she has been illegally dispossessed from the property.

Learned advocate for the State submits that on the basis of complaint of son of the deceased tenant steps have been taken by the police authorities, FIR has been registered and thereafter police authorities have taken steps in accordance with law.

Learned advocate for the petitioner is aggrieved by the action of the police authorities as the petitioner is an aged lady and there was infraction of the provisions of the BNSS, 2023. Further according to him the police has exceeded their action by aiding the complainant. Be that as it may, since the Criminal Court is already in siesin of the issue, the Criminal Court would

be better in a position to decide whether there have been any dispute, so far as it relates to the illegal handing over the property or the keys are concerned. The same is absolutely the domain of the jurisdictional Civil Court or Criminal Court.

With the aforesaid observations WPA 6317 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
