The Secretary of the West Bengal Madrasah Service Commission has filed a report in the form of affidavit wherein it has been mentioned that due to mistake in the application, the petitioner's name could not be included in the list of candidates for general transfer under West Bengal Madrasah Service Commission. However, the petitioner's name will be included in the final list before the counselling of general transfer for the subject Advance Arabic Theology (H/PG). In view of the aforesaid averment, which has been made on oath in the report there is no requirement of proceeding with the writ petition any further.

Learned advocate for the Commission has assured that the name of the petitioner will be included in the final list of counselling.

In view of the above, the writ petition stands disposed of.

Report in the form of affidavit filed on behalf of the respondent nos. 3 and 4 filed in Court today is taken on record.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
