1. Affidavit-of-service filed in Court today is taken on record.

The writ petitioner has alleged in this case that in spite of an order passed by the Secretary, State Transport Authority, West Bengal on October 13, 2025 to duly adhere to the respective timetable, the private respondent is causing hindrance in smooth plying of vehicle by the petitioner over the route as per his permit that is, from Midnapur to Tata, by deliberately violating the same.

3. Mr. N.I. Khan, learned counsel appearing for the petitioner submits that the private respondent is an operator over the route from Bishnupur to Tata, whereas both of them have been provided with their respective timetables.

4. Allegedly, the private respondent has been flouting the timetable given to him.

Mr. Khan, says that after the decision of the State Transport Authority, West Bengal dated October 13, 2025 directing the parties to ply their respective vehicles strictly as per timetables as approved by the State Transport Authority, West Bengal, there has been violation thereof by the private respondent.

6. He says that in this regard the petitioner has made written representation to the authority again, that is, dated March 6, 2025, which is still pending, for consideration of the STA, West Bengal.

7. Mr. Pantu Deb Roy, learned Additional Government Pleader along with Mr. Pannalal Bandopadhyay, learned counsel appears for the State.

8. A report has been submitted by the Secretary, State Transport Authority, West Bengal that is, dated March 24, 2025. Let the same be taken on record.

9. Mr. Deb Roy, submits that the grievance of the petitioner by dint of his letter dated March 6, 2025 has been taken cognizance of and necessary steps have been taken to obtain the report in that regard from the competent person as well as hear the parties after obtaining such report.

Ms. Aishwarya Rajyashree, learned counsel is appearing for the private respondents.

She has alleged about the violation being caused by the petitioner himself instead of the private respondents as alleged.

Having heard the learned counsels for the parties and having perused the records, the Court is of the considered opinion that since the steps have already

been taken by the STA, West Bengal to address the issues and grievance raised by the petitioner by dint of his letter dated March 6, 2025, the present case may be disposed of by directing the said authority to conclude the proceeding and decide as regards the written representation of the petitioner dated March 6, 2025, in due course, to bring it to a logical conclusion. 13.

A report has already been called for by the said authority in connection with the same. Let the authority afford opportunity of hearing to the petitioner and the private respondents and consider the report when obtained.

Let the petitioner's representation be disposed of as above, after consideration of all these, by dint of a reasoned order.

The entire exercise as above shall be concluded by the respondent no. 3/The Secretary, State Transport Authority, West Bengal within a period of four weeks from the date of communication of copy of this order. 16.

If it so requires, the respondent No. 3 may seek for urgent submission of report as called for by it. Its decision shall be communicated to the parties within a period of one week from its date.

Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

With the above observations and directions, the writ petition being No WPA 6321 of 2025 is disposed of, along with the pending applications, if any.
