The petitioner's prayer before the Municipality seeking cancellation of the sanctioned plan and demolition of the unauthorized construction made at the instance of the private respondent is pending consideration.

The learned Counsel representing the Municipality is yet to receive instruction in the matter.

As it appears that the representation filed on behalf of the petitioner is pending consideration at the end of the Municipality, accordingly, the instant writ petition is disposed of by directing the respondent no.4 being the Board of Councilors, Tamralipta Municipality to consider

and dispose of the representation dated 24 January, 2023 in accordance with law after giving reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of twelve weeks from the date of communication of this order.

A reasoned order shall be passed and communicated to the parties.

The parties will be permitted to rely upon all documents in support of their stand at the time of hearing.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
