1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner submits that there is a dispute between the petitioner and private respondents centering around construction attempted to be made by the parties.

3. Prayer is made in this writ petition for giving direction upon the police authorities which would ensure the petitioner to enjoy peaceful possession over the property in question.

4. Respondent nos. 8, 9 and 12 and State respondents are represented by learned advocates.

5. It is submitted by the learned advocate representing respondent nos. 8, 9 and 12 that a Title Suit being no. 674/2025 was instituted against the petitioner and same is pending.

Submission made on behalf of the petitioner regarding his right over the property in question is disputed by the learned advocate representing the private respondents.

6. Learned advocate representing the State respondents has filed a communication dated 19th March, of Officer-in-Charge, Rajabagan P.S., Kolkata and same is taken on record. Copies of the communication dated 19th March, 2026 are made over to the learned advocates representing the petitioner and respondent nos. 8, 9 and 12.

7. It is disclosed in the communication dated 19th March, 2026 that criminal prosecutions are pending against petitioner as well as private respondents originated from the complaints made by the petitioner and private respondents.

8. Since dispute arose concerning construction work at the property in question petitioner and private respondents shall be at liberty to approach the appropriate forum for remedy.

Police authority is not the appropriate

authority to decide the inter se right of the parties over the property in question.

9. However, police authorities are directed to maintain peace and tranquility at the locale where property situates.

10. Writ petition stands disposed of.

11. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
