Dhara ... for the petitioners Mr. Prantik Garai ... for the State Mr. Suman Basu Mr. Sushanta Malkhandy ... for the respondent no. 3 The husband of petitioner no. 1 and father of petitioner nos. 2 and 3, Sashinath Ganguly, since deceased, retired from the post of Graduate Laboratory Instructor at Ramananda College, Bishnupur on attaining superannuation on 30.11.2004. He died on 18.12.2014. During his lifetime, Sashinath was provided with regular pension. After his death the pension was revised in the year 2015 and consequently the family pension was also revised. It is not in dispute that petitioner no. 1 is receiving the revised family pension.
Learned counsel appearing for the petitioner submits that though the pension of Sashinath was revised, the arrear pension, viz., the Lifetime Arrear (LTA) of revised
pension was not paid to her for the period from 01.12.2004 to 18.12.2014.
It appears that respondent no. 3 had issued an admissibility report in respect of the revised pension of Sashinath by an office order dated 30.03.2023 addressed to the Director of Public Instructions, West Bengal seeking sanction order for payment of lifetime arrear (LTA) of revised pension in favour of the petitioners. It has been submitted by the learned counsel appearing for the petitioner that no steps have been taken by the Director of Public Instruction, West Bengal to resubmit the pension case alongwith specific sanction order for payment of lifetime arrear (LTA) of revised pension. In that view of the matter, I dispose of this writ petition with a direction upon the Director of Public Instruction, West Bengal to take necessary steps in response to the communication dated 30.03.2023 issued by respondent no.
3 within a period of two months from the date of communication of this order. Needless to mention that upon receipt of the necessary orders from the Director of Public Instruction, West Bengal, respondent no. 3 shall take necessary steps within a period of one month thereafter.
Accordingly, WPA 6874 of 2024 is disposed of. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
