Proshanto Biswas v. State Of West Bengal
08.07.2021 Ct No. 35 D/L 3 ab C.R.M. 2602 of 2021 (Via Video Conference) Re: An application for bail under Section 439 of the Code of Criminal Procedure filed in connection with Gaighata Police Station Case No. 69 of 2021 dated 28.01.2021 under Section 14 of the Foreigners Act, 1946.
In Re: Proshanto Biswas, ... petitioner Mr. Purnasish Gupta, Ms. Mary Datta, ... for the petitioner Mr. Swapan Kumar Banerjee, Ms. Purnima Ghosh, .... for the State Learned advocate for the petitioner submits that the petitioner is in custody for about 160 days.
He further submits that the competent authorities have issued Aadhar Card, PAN Card and Ration Card in favour of the petitioner and he also has a back account in the State Bank of India at Barrackpore.
It appears that a report was sought for on June 8, 2021 regarding the genuineness of the HPCL card/ration card purportedly issued in favour of the petitioner. Today, a report has been filed on behalf of the State. The enquiry report reveals that the HPCL card issued in favour of the petitioner is genuine.
In that view of the matter, I am of the opinion that further custodial interrogation of the petitioner is not necessary. Accordingly, the prayer for bail is allowed.
The petitioner, namely, Proshanto Biswas, shall be released on bail upon furnishing a bond of Rs. 5,000/- (Rupees Five Thousand Only), with one surety of like amount, to the satisfaction of the learned Additional Chief Judicial Magistrate, Bangaon.
Let the report filed by the State in Court today, be kept with the record.
The application for bail being CRM 2602 of 2021 is, thus, disposed of.
