Learned counsel for the petitioner contends that pursuant to the order of the Secretary, State Transport Authority, West Bengal, as annexed at page-24 of the writ petition, the petitioner has already submitted a written declaration in proper form to the effect that he will never violate any permit condition and comply with the Rule as per permit condition and approved time-table and that the petitioner will abide by the decision of STA as per provision of law. However, the respondent authorities have not yet issued an approved time-table in favour of the petitioner to enable the petitioner to run his bus on the route-in-question.
Learned counsel appearing for the respondent authorities submits that, in principle, the respondents have no objection to do so in the event a valid declaration has been filed by the petitioner.
In such view of the matter, WPA 6084 of 2022 is disposed of by directing the respondent no.3, that is, the Secretary, State Transport Authority, West Bengal to issue and approve a time-table for the proposed route of the petitioner for the purpose of the petitioner plying his vehicle, subject to the petitioner submitting a written declaration in terms of the order pursuant to the hearing dated January 13, 2022 passed by the Secretary, State Transport Authority (annexed at page-24 of the present writ petition).
In the event such declaration is or has been filed, the respondent no.3 shall issue such approved time-table as expeditiously as possible, preferably within a fortnight from date.
There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
