(A) 989 of 2025 24.03.2025 DL-15 (AD) (Allowed) In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Balurghat Police Station Case No.1014 of 2024 dated 27.12.2024 under Sections 14A(b)/14C of the Foreigners Act read with Section 61(2) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to G.R. Case No.2467 of 2024) pending before the Learned Chief Judicial Magistrate, Dakshin Dinajpur at Balurghat.

And In the matter of: Sujan Das ....petitioner Mr. Kaushik Chowdhury, Advocate ...for the petitioner Mr. Atif Ahmed Siddiqui, Advocate ... for the State.

1. Petitioner before us is an Indian national as submitted on behalf of the State.

2. The issue as to whether the petitioner was instrumental in harbouring foreign national, may be decided at the trial.

3. Police filed charge sheet.

4. In such circumstances, we grant anticipatory bail to the petitioner.

5. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioner shall appear on every date before the

jurisdictional Court on and from the date fixed for appearance of the accused and in default, the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.

6. The prayer for anticipatory bail of the petitioner is allowed.

7. C.R.M. (A) 989 of 2025 is disposed of.
