Petitioners are aggrieved by the fact that their 04.04.2025 Court No. 35 Item No.99 Rakib possession has been interfered at the behest of the private respondents and to that effect they have informed the local police authorities. Inspite of receipt of such information the police authorities did not take any steps. As such the petitioner is unable to raise boundary wall as also cultivate in the land in issue.

State has submitted a report of the Inspector-inCharge, Arambagh police station which reflects that petitioners never went to the land in question for cultivation, as such there was no issue of confrontation with the private respondents.

Be that as it may, so far as the right, title, interest, possession, usage and occupation is concerned it is for the Civil Court to decide the issue. This Court will only assess whether there has been any dereliction of the

police authorities in respect of any legal action to be taken.

Having considered the nature of dispute, I direct that the police authorities would oversee that there is no breach of the peace and/or tranquility and/or any untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 6324 of 2025 is disposed of.

Report submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
