Versus

Meeta Mohanty Mr. Debrup Choudhury Mr. Immy Ansari ...for the petitioner This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 5th Court at Alipore to dispose of the Matrimonial Suit No.2880 of 2016 expeditiously. In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.

From the order sheets appended to this application this Court finds that Miscellaneous Case No.447 of 2023 is also pending.

The learned advocate appearing for the petitioner submits that the misc case is pending and this is the third round of litigation.

In the light of the submissions made by the learned advocate for the petitioner CO 1001 of 2025 is disposed of by requesting the learned Additional District Judge, 5th Court at Alipore to dispose of Matrimonial Suit No.447 of 2023 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

After disposal of the misc case the learned Additional District Judge, 5th Court at Alipore shall make an endeavor to see that the Matrimonial Suit No.2880 of 2016 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
