Mr. Arijit Ganguly Mr. Sanjib Kumar Das ...... for the State Having considered the materials on record and the extent of complicity of the petitioners in the commission of the alleged offence as well as taking consideration of the statement of the complainant under Section 164 of the Cr.P.C., we are inclined to grant anticipatory bail in respect to the petitioner nos. 2 and 4, namely Shiben Mondal @ Shibendra Nath Mondal and Nakul Mondal @ Nakul Chandra Mondal.
Accordingly, we direct that in the event of arrest, the petitioner nos. 2 and 4 shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that they must meet with the Investigation Officer once in a week. In breach of any of the aforesaid conditions,
the anticipatory bail in respect of the petitioner nos. 2 and 4 shall stand automatically cancelled.
The prayer for anticipatory bail in respect of the petitioner nos. 1 and 3, namely Biplab Mondal @ Biplab Kumar Mondal and Rathin Mondal @ Rathindra Nath Mondal is rejected.
