The West Bengal State Electricity Distribution Company Limited & Ors. Md. Kutubuddin ...for the Petitioner Mr. Asif Dewan ...for WBSEDCL The petitioner seeks an electricity connection for operating his submersible pump set.

Learned advocate appearing on behalf of the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that the connection could not be effected due to the absence of a way-leave from the owners of adjoining plots.

In view of Rule 3(b) of the Works of Licensees Rules, 2006, liberty is granted to the petitioner to approach the concerned District Magistrate for resolution of the said dispute.

If the petitioner submits a representation before the District Magistrate within a period of two weeks from the date of communication of this order, the same shall be considered and disposed of by the District Magistrate after affording an opportunity of hearing to the petitioner,

WBSEDCL, and all other concerned parties. The matter shall be resolved within a period of three months from the date of receipt of the representation.

It is needless to mention that in the event the District Magistrate issues any direction for effecting the electricity connection in favour of the petitioner, the petitioner shall comply with all technical and statutory formalities as required by WBSEDCL.

Accordingly, WPA 6327 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
