The petitioner is aggrieved by an order dated 26th June, 2020 issued by the Commissioner of School Education, West Bengal. By the said order, the application of the petitioner for compassionate employment has been rejected.

It has been found by the respondents that the petitioner's family income exceeds Rs.10,200/- per month, which is higher than the gross monthly pay of a Group D employee of the State.

The petitioner submits that his mother had taken voluntary retirement on medical grounds and has huge medical expenses. The present family income, therefore, is not sufficient to meet the said expenses.

While this Court sympathizes with the petitioner's condition and it is quite likely that the petitioner's mother incurs huge expenses on her medical treatment, given the fact that she was retired on medical grounds, this Court cannot compel the State to deviate from its scheme for compassionate employment.

The State has other medical facilities like Swasthya Sathi and other insurance facilities are also available to the petitioner to secure his mother's medical treatment.

In these circumstances, no relief can be granted to the petitioner.

With the aforesaid observations, the writ petition is dismissed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
