ct, no.42 CRR 1004 of 2020 In Re : Sujit Kumar Ghosh .............petitioner. In the matter of : An application under Section 482 of the Code of Criminal Procedure in connection with Falta P. S. Case No. 36 of 2017 dated 09.02.2017 under Sections 447/324/325/379/354A /506B/34 of the Indian Penal Code pending before the Learned Judicial Magistrate, 3rd Court, Diamond Harbour, South 24 Parganas(G.R. Case No. 329 of 2017).

Mr. Soumya Banerjee .....for the petitioner.

The petitioner is aggrieved by the police report submitted by the Investigating Agency in connection with Falta Police Station Case No. 36 of 2017 dated 09.02.2017 under Sections 447/324/325/379/354A /506B/34 of the Indian Penal Code.

Mr. Banerjee, learned advocate appearing for the petitioner is aggrieved by the fact that although initially the police authority did not file a charge-sheet, but pursuant to a direction for further investigation chargesheet has been submitted against the present petitioner.

Having regard to the fact that the documents on which the prosecution intends to rely to prove its case are yet to be supplied to the petitioner, I am of the opinion that the present revisional application and the points so canvassed are premature. The petitioner is granted liberty to agitate the points canvassed in the revisional application at the stage of consideration of charge.

With the aforesaid observations, CRR 1004 of 2020 is disposed of.

Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
