Kutubuddin ... ... for the State In pursuance of the direction passed by this Court earlier on 2nd April, 2024 a report is submitted by the Officer-in-Charge, Churulia Out Post, Jamuria Police Station stating that the appellant Patit Paban Nandy and Bandana Nandy had expired on 23.08.2009 and 03.11.2016 respectively as reflected from a death certificates, which is tagged with the report. As both the appellants have already expired, so the instant appeal stands abated.

The instant appeal be and the same is dismissed as abated. The appeal being CRA 278 of 1995 is disposed of. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
