Mr. Ziaul Islam, learned counsel appears for the petitioner.

None appears for the respondents, despite notice. The last order dated April 8, 2025 speaks for itself.

The sole grievance of the petitioner is that the departmental appeal in annexure P-9 (page 32) to the writ petition was preferred on January 6, 2025 is still pending before the jurisdictional Appellate Authority being the respondent no.2 herein.

In view of the above, the respondent no.2 is directed to decide the appeal by passing a reasoned order strictly in accordance with law following the statutory procedures.

The entire exercise shall be carried out by the respondent no.2 positively within a period of six weeks from the date of communication of this order. The petitioner and other necessary parties then shall collect

the reasoned order from the Office of the respondent no.2 on usual terms.

It is made clear that this Court has not gone into the merits of the claim in the appeal preferred by the petitioner and in this writ petition and the respondent no.2 being the jurisdictional Appellate Authority shall be free to decide the appeal by applying its independent mind but strictly in accordance with law.

Since no affidavit-in-opposition is called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the aforesaid observations and directions, this writ petition being WPA 6343 of 2025 stands disposed of without any order as to costs.
