The petitioner is aggrieved by the fact that the private respondent(s) in order to grab his property are trying to change the nature and character of the same. To that extent, they intended to excavate a pond which was resisted by the petitioner for which the petitioner was threatened by brandishing firearms.

State has submitted a report which reflects that there is a land dispute between the petitioner and the private

respondents and, in order to maintain peace, a proceeding under Section 126 of the BNSS has been drawn up against both the parties.

Having considered that the nature of the dispute has a flavor of a civil proceeding, the petitioner, if so advised, would approach the learned jurisdictional Civil Court for appropriate remedies for resolving the said land dispute.

The police authorities have been maintaining a strict vigil, they would continue with their surveillance as also ensure that no breach of the peace and/or tranquility taking place and/or no untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 6351 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
