The grievance of the petitioner is that, by order dated 19.11.2019, the learned Judicial Magistrate, 1st Court, Alipore, South 24 Parganas was pleased to file the case as the accused, namely, Rajiv Nandini could not be traced in spite of efforts by the police authorities.

In view of the failure of the police authorities to trace out the accused, I direct that CID, West Bengal will take steps to trace out the accused and each and every month they would submit a report before the learned Judicial Magistrate regarding the steps taken or the procedure adopted for tracing out the accused. With the aforesaid directions, Accordingly, CRR 763 of 2021 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
