During the pendency of the appeal the parties have filed an application for mutual divorce for dissolution of marriage under Section 28 of the Special Marriage Act, 1954. Learned District Judge, Barasat dissolved the marriage by a decree of divorce on mutual consent on 21.7.2022. In view of the aforesaid order, the impugned order stands set aside.
We dispose of the appeal by recording that the marriage was solemnized under the Special Marriage Act on 25.1.2010 stands dissolved w.e.f. 21.7.2022.
As the application is disposed of, the Photostat copy of the demand draft of Rs. 5,00,000/- lakhs each aggregating a sum of Rs.10,00,000/- is kept with the record. The original demand drafts are handed over to the appellant / wife in Court today.
The appeal with the connected applications are disposed of.
