None appears for the Panchayat despite service. Alleging illegal/unauthorized construction raised by the private respondents who are members of a club being the 9th respondent, the petitioner approached this Court in a writ petition being WPA No. 18856 of 2022. By an order passed on September 26, 2022, a coordinate Bench of this Court granted liberty to the petitioner to approach the permission granting authority in accordance with law by filing a specific complaint with his allegation. The mode and manner of dealing with the said representation by the concerned authority were laid down by the learned Single Bench. Since the said order was not complied with, a contempt application was filed. By an order passed on
August 12, 2025, this Court directed the Zilla Parishad to inform the petitioner whether the said authority is the permission granting authority or not. Pursuant to such order, the Zilla Parishad, by a letter issued on August 14, 2025, requested the petitioner to submit the complaint before the Gram Panchayat Authority in terms of the order passed by this Court. The petitioner submitted a complaint before the concerned authority on November 10, 2025 and seeks consideration of the same.
In view of the above, the Pradhan, Jangipara Gram Panchayat, being the 6th respondent herein, is directed to consider and dispose of the complaint submitted by the petitioner dated November 10, 2025 within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law.
The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction allegedly raised by the private respondents is found to be unauthorised/illegal, the concerned authority shall take necessary steps, in accordance with law.
The writ petition is disposed of.
There shall, however, be no order as to costs.
Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
