The revisional application has been filed praying for expeditious disposal of the Title Suit No.64 of 2020 pending before the learned Civil Judge (Senior Division) at Durgapur. The petitioner submits that the petitioner is the defendant no.3 in the title suit. The petitioner submits that as the defendant nos.1 and 2 are not appearing, the learned court below is not proceeding with the disposal of the injunction application.

This Court has neither gone into the merits of the suit nor into the merits of the application. An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite parties is not required. The prayer is innocuous.

Having considered the records, this Court is of the view that justice would be sub served if the learned court below is directed to dispose of the injunction application within a period of three months from the next date fixed upon granting one last chance to all the parties to file their necessary objections to the said application. After disposal of

the aforementioned application, the learned court shall make all endeavour to ensure that the suit progresses expeditiously.

Accordingly, the revisional application is disposed of. However, there will be no order as to costs.

Petitioner is directed to serve a copy of the revisional application upon the opposite parties, along with the server copy of this order.

Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
