Report submitted by the learned advocate appearing for the State be kept with the record.

Learned advocate appearing for the petitioners submits that the petitioners are renewing their prayer for bail. There was earlier incorrect facts placed on behalf of the prosecution which weighed with this Court for rejecting the prayer for bail. Learned advocate submits that subjectmatter of the case relates to alleged recovery of 1000 bottles of Phensedyl from four accused persons including the present three petitioners. Petitioners are in custody for 15 months. Prosecution has relied upon 14 witnesses to prove its case and till date, only one witness has been examined (earlier it was incorrectly submitted that four witnesses have been examined).

Learned advocate appearing for the State has submitted a report which reflects that one witness has been examined till date and 13 witnesses are proposed to be examined by the State. Report also reflects that there are no criminal antecedents of the petitioners.

Having considered the fact that 13 more witnesses are to be examined and the same would consume some more time, I am of the view that further detention of the present petitioners in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioners is allowed.

Accordingly, the petitioners viz., 1. Riju Ghosh, 2. Sudip Ghosh and 3. Biswajit Swarnakar shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Krishnagar, Nadia.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 516 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
