1. Affidavit of service filed in Court today is taken on record.

2. The contempt application is at the instance of the private respondent in the writ petition. It has been submitted that the water connection has been given to the writ petitioner over the plot of land which is the subject matter of dispute in the pending suit.

3. It appears that vide order dated 10th October, 2023 the Court disposed of the writ petition by directing the municipality to grant water connection and at the same time recorded that the grant of water connection will not create any equity in favour of the petitioner. The suit shall be decided by the learned Court strictly on merits without being influenced by the order or any observation made therein.

4. The authority has taken steps in compliance of the order passed by the Court and granted water connection. The same will not create any right or equity in favour of the writ petitioner.

5. The contempt application stands disposed of.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
