1. Affidavit of service filed in Court today is taken on record.

2. The petitioner's date of birth has been recorded in the passport as 23rd November, 1996.

All other certificates/documents of the petitioner mention his date of birth as 23rd April, 1997.

3. Learned advocate for the petitioner submits that the date of birth recorded in his birth certificate is erroneous.

4. The petitioner prays for correction of his date of birth as recorded in the passport.

5. It appears that the date of birth was recorded in the passport relying upon the certificate issued by the panchayat. The petitioner produced the certificate issued by the panchayat at the time obtaining the passport. A person cannot have two birth certificates.

6. It will be open for the petitioner to take necessary steps for correction of the date of birth as recorded in his birth certificate.

7. On obtaining the proper birth certificate recording the correct date of birth, the petitioner may apply before the passport issuing authority for issuance of fresh passport.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
