Advocate Ms. Priyamvada Singh ..for the State The petitioner claims to be the recorded owner of certain plots of land within Mouza Dewanmaro, J.L. No. 85 under Police Station Kharagpur in the District of Paschim Medinipur. The petitioner approached the authorities of the West Bengal Electricity Distribution Corporation Limited for supply of electricity for the purpose of establishing an industrial unit. The petitioner states that the authorities of the WBSEDCL informed the petitioner that the plots of land in question is the subject matter of acquisition proceeding. The petitioner alleges that no notice was served upon the petitioner in spite of the fact that the petitioner is the recorded owner of the aforesaid plots of land.
The petitioner approached various authorities in order to ascertain as to whether the plots of land recorded in the name of the petitioner was the subject matter of any acquisition proceeding.
submitted a representation dated 29th October, 2025 before various authorities including the Land Acquisition Collector, Paschim Medinipur. The petitioner also filed an application seeking information under the provisions of the Right to Information Act, 2005 dated 24th November, 2025. Alleging in action on the part of the authorities in not supplying the information sought for by the petitioner, the instant writ petition has been filed.
Mr. Galib, learned Senior Government Advocate submits that in the event the petitioner is aggrieved by non-supply of information under the provisions of the Right to Information Act, 2005 the said statute provides for an appellate remedy as well as the second appellate remedy. He submits that in the representation submitted by the petitioner before the L.A. Collector dated 29th October, 2025, the petitioner also sought for the information which was prayed for by the petitioner under the Right to Information Act.
Faced with such situation, the learned advocate appearing for the petitioner, on instructions, submits that the petitioner is not pressing the prayer seeking direction upon the authorities to supply the information as sought for by the petitioner under the provisions of the Right to Information Act, 2005 vide letter dated 24th November, 2025.
After some argument, learned advocate appearing for the petitioner submits that the present
grievance of the petitioner has also not been properly reflected in the representation dated 29th October, 2025. He prays that a liberty be granted to the petitioner to submit a comprehensive representation before authorities of the Land Acquisition Department ventilating his grievances.
In the light of the submissions made by the learned advocate for the petitioner, WPA 6926 of 2026 stands disposed of without entering into the merits of the claim made by the petitioner in this writ petition and by leaving petitioner free to submit a comprehensive representation before the appropriate authority ventilating his grievances. If such a representation is submitted, such authority shall consider and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorized representative. The entire exercise shall be completed as expeditiously as possible and in accordance with law.
There shall be however no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
