The requisite qualification as prescribed by National Council for Teacher Education for participating in the recruitment examination is Graduation with at least 50% marks and Bachelor of Education.
The petitioners contend that all the candidates are graduates and have the qualification of Bachelor of Education.
Apart from having the above qualification the petitioners have also obtained certificate from the National Institute of Open Schooling and have successfully completed six month certificate course in Professional Development Programme for Elementary Teachers (PDPET). The petitioners pray for direction upon the respondent
authorities to consider their above qualification for the purpose of selection of the primary teachers. The learned advocate for the petitioners candidly submits before this Court that there is no document to show that the respondent authorities were taking into consideration other qualifications apart from what that are mentioned in the NCTE Notification dated 28th June, 2018. Learned advocate representing West Bengal Board of Primary Education submits that the minimum eligibility qualification required for participating in the recruitment process of primary teachers is graduation with at least 50% marks and Bachelor of Education qualification. Apart from the above there is no requirement for taking into consideration other qualifications which a candidate may have obtained.
As it has been submitted by both the parties that the minimum qualification for participating in the recruitment process of primary teachers is only Graduation and Bachelor of Education degree accordingly, the Court does not find any reason to direct the authority to take into consideration other qualifications which are not required or not mentioned in the advertisement for recruitment. In that view of the matter, no relief can be granted to the petitioners in the instant case.
The writ petition fails and is hereby dismissed. The receipt showing submission of deficit court fees by e-challan dated 4th October, 2021 is taken on record.
