1. Report submitted by the State in respect of the service effected upon the private opposite party be kept with the record.

2. Learned Advocate appearing for the petitioner submits that the petitioner is in custody for four years two months and till date the trial of the case has not been completed.

3. Learned Advocate for the State has produced the Case Diary.

4. I have perused the statement of the victim under Section 164 of the Cr.P.C and the medical report which

was refused. The accusations primarily do not reflect that the medical examination at all was called for in the present case.

5. Having considered the period of detention of the present petitioner and without entering into the merits of the case I am inclined to release the petitioner on bail.

6. Accordingly, the petitioner be released on bail on such terms and conditions as the learned Special Court deems fit and proper.

7. Thus CRM (M) 723 of 2026 is allowed.

8. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
