1. Learned advocate for the appellant is represented.

2. Learned advocate for the State is present.

3. In pursuance of the direction, a report is submitted by the Officer-in-Charge, Durgapur P.S., ADPC stating that during pendency of this appeal, the sole appellant, Subha Chandra Nayak @ Subhas Nayak was expired on 29.05.2025. A photocopy of certificate of death was collected by the concerned police station and tagged with the record which also affirms the death of the appellant.

4. As the sole appellant has been expired during pendency of this appeal, the instant appeal stands abated against him.

5. The report, submitted by the Officer-in-Charge, Durgapur P.S., ADPC which is handed over by the learned advocate for the State, be kept with the record.

6. Thus, the instant criminal appeal be and the same is hereby dismissed.

7. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
