1. Report submitted by the State in respect of the service effected upon the victim be kept with the record.

2. Learned Advocate appearing for the petitioner submits that the petitioner is in custody for more than three years ten months and till date eight witnesses have been examined and the prosecution proposes to examine fourteen witnesses.

3. Learned Advocate has forwarded the evidence of the minor victim aged about four years.

4. Learned Advocate for the State opposes the prayer for bail, produces the Case Diary and draws the attention of the Court to the statement of the victim under Section 164 Cr.P.C. as well as the medical examination.

5. I have taken into account the materials which are appearing in the Case Diary, the evidence of the victim and without entering into the merits of the case I am of the view that further detention of the petitioner is unwarranted. As such prayer for bail of the petitioner is allowed.

6. Accordingly, the petitioner be released on bail on such terms and conditions as the learned Special Court deems fit and proper for ensuring his further appearance in course of the trial.

7. Accordingly, CRM (M) 725 of 2026 is allowed.

8. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
