August 24, 2021 Bpg.

In Re: An application under Sections 397, 401 and 482 of the Code of Criminal Procedure, 1973.

Manish Kumar Sharma

Versus

State of West Bengal and Anr.

Mr. Aniket Mitra.

...for the WBSEDCL.

Mr. Sandip Chakraborty.

...for the State.

Mr. Sandip Chakraborty, learned advocate appearing for the State submits a report forwarded by the Inspector-in-Charge of Baguiati Police Station. The report reflects that the charge-sheet was submitted way back in the year 2011 and the learned Special Court was pleased to fix date for framing of charge. Having regard to the fact that the petitioner approached this Court at the stage when charge-sheet was submitted and the copies were not supplied under Section 135(1)(a) of the I.E. Act, I am of the view that the revisional application was preferred at a premature stage and, as such, no interference is called for. The petitioner will be at liberty to agitate the points canvassed in the revisional application at the stage of consideration of charge.

With the aforesaid observations, CRR 827 of 2012 is disposed of.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.

Learned jurisdictional court is directed to see that the date of the trial is scheduled and fixed so that the same can be concluded within a reasonable period of time. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
