In the matter of : Smt. Jolly Dasgupta. ...petitioner. The present revisional application has been preferred in respect of an order dated 07.09.2011 passed by the learned Judicial Magistrate, Third Court, Barrackpore in Misc. Execution Case No.10 of 2012 arising out of Misc. Case No.6 of 2010. Records of this revisional application reflect that the matter appeared on 16.05.2012 and 3.10.2012 and the same has not been admitted till date.
Having regard to the contentions advanced by the petitioner, I direct the learned Judicial Magistrate, Third Court, Barrackpore to consider the points canvassed in the revisional application, if the issue is still pending before the learned Magistrate. However, this Court at this belated stage is not in a position to pass any order or direction upon the learned Magistrate so far as the arrears are concerned.
Accordingly, CRR 831 of 2012 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
