1st March, (AK) W.P.A 7311 of 2021 Hafijul Sk.

Vs.

The State of West Bengal and others (Via Video Conference) Mr. Goutam Banerjee Mr. Sandip Kumar Mondal ...for the petitioner.

Mr. Arjun Samanta ...for State.

Learned counsel appearing for the respondents hands over photocopies of written instructions indicating that, pursuant to the order dated February 17, 2022 of this court, all relevant papers were handed over to the petitioner.

Learned counsel appearing for the petitioner agrees, but submits that the petitioner still has certain grievances against the respondents insofar as the information handed over to the petitioner is concerned. However, even if the petitioner has any grievance in respect of the information supplied to the petitioner, the same furnishes a fresh cause of action and it is beyond the scope of the present wit petition to enter into the merits of the same.

In view of the grievance ventilated in the present application having already been redressed, WPA 7311 of 2021 is dismissed as infructuous, with liberty to the petitioner to file a fresh writ petition, if the petitioner to so desires, agitating any further grievance of the petitioner in respect of the information subsequently handed over to the petitioner.

This order shall not be construed as a bar to the adjudication of such fresh writ petition on merits, if filed. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
