Learned Counsel appearing for the petitioner submits that the petitioner was not physically well because of her pregnancy, and could not sit for final examination in the last semester in June 2019. The petitioner made several representations to the College, but the College and the University never allowed her to sit in the examinations. The petitioner prays that she should be allowed to sit for final year's examination which will start from 15th of March, 2021 at 11-00 a.m.

Mr. Choudhury, learned Counsel appearing for the University is present.

Heard both the parties.

The Controller of West Bengal University of Teachers'

Training Education Planning and

Administration is requested to consider this writ petition as a representation before him.

Learned Advocate-on-record of the petitioner is requested to serve a copy of this order along with a copy of the writ petition to the Controller of Examinations positively by tomorrow i.e. 13th March, 2021.

The learned Controller will consider the representation of the petitioner at 10-00 O'clock in the morning of 15th of March, 2021 and thereafter, if the Controller finds that the petitioner is eligible for appearing in the final semester, the Controller will allow the petitioner to proceed for the examination on 15th March, 2021. In case, the learned Controller of examination decides against the petitioner, the Learned Controller of examination will pass a reasoned order and communicate the same to the petitioner within two weeks from today.

As I have not gone into the merits of the case, all points are left open to the Controller of Examination to decide in accordance with law.

The writ petition is disposed of, however, no order as to costs.

Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
