Learned advocate appearing for the petitioner approached this Court as he was aggrieved that no FIR has been registered by the police authorities.

State has submitted a report wherefrom it reflects that Magrahat PS Case No. 96/25 was registered for investigation.

Having considered that a case has already been registered and a title suit is pending being TS No. 188/2002 before the learned Civil Judge, Diamond Harbour (Fast Track 2nd Court) I am of the opinion that the primary grievance of the petitioner relating to steps proposed to be taken by the police authorities have been subserved.

Since more than 90 days have passed, police authorities are directed to send a progress report to the defacto complainant. After receipt of the progress report petitioner would apply before the learned jurisdictional Magistrate relating to the necessary deficiencies in the investigation. Learned Magistrate would pass necessary directions if such an application is preferred by the petitioner. With the aforesaid observations WPA 6390 of 2025 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
