Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the present case on the basis of statement of co-accused and there has been no recovery from the petitioner although the subject matter of the case involves alleged recovery of 297 bottles of Codeine phosphate, 257 strips of Alpra Zolam Tablets and 36 strips of Nitrazepam Tablets and another 60 ampoules of avail injunction. It has also been contended that the petitioner is in custody for 8 months and charges have already been framed. Prosecution relied upon 12 witnesses to prove its case.

Learned advocate for the State opposes the prayer for bail and submits that there were monetary transactions and call data records available.

Having considered the period of detention of the petitioner and the time which will be consumed for taking the trial to its logical conclusion, I am of the view that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Abdul Kader shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional Sessions Judge, 1st Court, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Uttar Dinajpur without prior permission of the learned special court. Accordingly, CRM(NDPS) 518 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
