This writ petition is disposed of permitting the petitioner to approach the appropriate authorities on the allegations of forceful encroachment into the land of the petitioner and excavation of the soil from the said land. This issue cannot be decided by the police authorities as the question of title of the petitioner in respect of the said land has to be determined.

It appears that the petitioner had already approached the District Magistrate, Block Development Officer and the Block Land & Land Reforms Officer, with such prayers.

The petitioner is at liberty to approach the competent Court or the competent authorities with such allegations. If such allegation is made, the same shall be disposed of in accordance with law. The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
