20.05.2025 Item No.34 Ct.No.34 rc.
C.R.M. (DB) 1027 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Burdwan Police Station Case No. 733 of 2022 dated 08.07.2022. And In Re :
Ganesh Paswan ... Petitioner.
Mr. Uday Sankar Chattopadhya Ms. Rajashree Tah Ms. Trisha Rakshit Ms. Aishwarya Datta Ms. Bidisha Chakraborty Ms. Sadia Parveen ... for the Petitioner Ms. Amita Gaur Ms. Mausumi Sarkar ... For the State The petitioner is in custody for more than two years and renews his prayer for bail.
Learned counsel for the State opposes the prayer. It appears that the bail prayer of the petitioner was turned down earlier by this Court on merits. Allegation against the petitioner is extremely serious. The forensic report of the viscera sample of the deceased indicates that poisonous substance was detected therein. Seven persons died due to consumption of liquor from the shop of the petitioner. Out of thirty-seven witnesses, nineteen witnesses have been examined.
Considering the gravity of the offence as well as material on record, prayer for bail is rejected at this stage. The application is disposed of.
Case Diary is returned.
