The grievance of the petitioner is directed against non-supply of an electricity connection to the premises of the petitioner.

On behalf of CESC Ltd., it is submitted that by repeated correspondence they have intimated the petitioner that in view of an order passed by a Coordinate Bench dated 8th August, 2025 in WPA 17901 if 2023 (Dr. Syamal Kumar Lahiri Vs. The State of West Bengal & Ors.), there is no question of providing electricity connection to the petitioner.

It is further submitted on behalf of the CESC Ltd. that the premises where the petitioner resides is actually constructed on the East Kolkata Wetlands and in absence of any permission or lawful sanction from the appropriate Authorities, there is no question of the CESC Ltd. providing such connection.

In view of the clear embargo, there is no legal right which the petitioner can claim insofar as an electricity connection to the subject premises is concerned.

There is not only an order passed by a Coordinate Bench but serious issues in providing such electricity connection to premises situated in the East Kolkata Wetlands area.

With the above directions, WPA 6637 of 2026 stands dismissed.

Liberty is granted to the petitioner to approach the CESC Ltd., in case of any new facts of circumstances or subsequent facts emerge.
